Terms of Service

1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of Sensorly (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service under the supervision of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use of the Service.
3. Accounts & Security
You’re responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access. We may suspend or terminate accounts that provide false information or violate these Terms.
4. The Service
Sensorly lets you upload a still image, describe how it should move, and generate a short video clip. Each generation consumes credits from your account balance. Free accounts start with 50 credits; paid plans include additional credits on a recurring basis as described on our Pricing page. Unused credits do not roll over unless stated otherwise at time of purchase.
5. Your Content
You retain ownership of the images and prompts you submit (“Input Content”) and the video output generated from them (“Output Content”), subject to the rights of any underlying content you did not create. By submitting Input Content, you grant Sensorly a worldwide, non-exclusive, royalty-free license to host, process, and display that content solely to operate and improve the Service for you. You represent that you own or have the necessary rights to any image you upload, and that uploading it does not infringe a third party’s rights.
6. Acceptable Use
You agree to use the Service in accordance with our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations may result in content removal, suspension, or termination of your account.
7. AI-Generated Output
Video output is generated automatically and may contain errors, artifacts, or unexpected results. We do not guarantee that output will match your prompt exactly, be free of defects, or be suitable for any particular purpose. You are responsible for reviewing generated content before you rely on, publish, or distribute it.
8. Credits, Billing & Refunds
Paid plans are billed in advance on a recurring basis and automatically renew until cancelled. You can cancel anytime from Settings; cancellation takes effect at the end of the current billing period, and you keep any remaining credits until then. Except where required by law, payments are non-refundable.
9. Intellectual Property
The Service, including its design, code, and branding, is owned by Sensorly and protected by intellectual property laws. These Terms do not grant you any right to use Sensorly’s trademarks or branding without our prior written consent.
10. Termination
You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms, the Acceptable Use Policy, or applicable law, or if required to comply with a legal process.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
12. Limitation of Liability
To the maximum extent permitted by law, Sensorly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.
13. Indemnification
You agree to indemnify and hold Sensorly harmless from any claims, damages, or expenses arising from your use of the Service, your Input Content, or your violation of these Terms.
14. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising from these Terms will be resolved in the courts located in Ontario, Canada, unless applicable law requires otherwise.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we’ll post the updated Terms with a new “Last updated” date and, where appropriate, notify you by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
