Copyright & DMCA Policy

1. Overview

Sensorly respects the intellectual property rights of others and expects users of the Service to do the same. This policy explains how to report copyright infringement and how we respond to those reports under the U.S. Digital Millennium Copyright Act (“DMCA”) and Canada’s notice-and-notice regime under the Copyright Act.

2. Filing a Notice of Infringement

If you believe content hosted on Sensorly infringes your copyright, send a written notice to our designated agent below that includes:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material you claim is infringing, with enough detail for us to locate it (for example, a URL or thread link).
• Your contact information: name, address, telephone number, and email address.
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

3. Counter-Notification

If you believe content you uploaded was removed in error, you may submit a counter-notification containing:

• Your physical or electronic signature.
• Identification of the removed material and where it appeared before removal.
• A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
• Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district, and that you will accept service of process from the person who filed the original notice.

We may restore the material after 10–14 business days unless the original complainant files a court action seeking an order to restrain you from further infringing activity.

4. Repeat Infringer Policy

We will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.

5. Designated Copyright Agent

Notices and counter-notices should be sent to our designated agent at dmca@sensorly.ca.

6. False Claims

Submitting a false or bad-faith infringement notice can expose you to liability for damages, including costs and attorneys’ fees. Please make sure you have a good-faith basis before filing a notice.
